Official Out Living It Contest Rules

OFFICIAL CONTEST RULES

 

NO DONATION OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.

 

Contest Details: The Polartec® Out Living It Challenge Contest (“Contest”) is a nationwide fundraising campaign to show support for college cancer fighters and to raise money for FIRST DESCENTS, a non-profit organization that provides adventure programs for adults ages 18 to 39 who are fighting cancer.  The Contest is a fundraising challenge in which the top three teams (“Teams” or “Entrants”) that raise the most money for FIRST DESCENTS will receive a Contest prize package.  A Team may be composed of a single person or a group of individuals who work together to raise money for FIRST DESCENTS.  Each Team will create and promote an event, such as a 5k or 10k race, climbathon, golf tournament, costume relay, mini triathlon, or hikeathon (“Event” or “Events”) to raise money for FIRST DESCENTS.  Donations will be made directly to FIRST DESCENTS using the Team’s dedicated fundraising page link, which FIRST DESCENTS will provide.

 

Eligibility: Except where regulated or restricted by law, the Contest is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older AND a registered college student at the time of entry. Employees, contractors, directors, and officers, and their immediate families and household members of Polartec®(“Sponsor”), FIRST DESCENTS (Beneficiary) and their affiliates, subsidiaries, divisions, and advertising and promotion agencies (collectively, “Promotion Parties”) are not eligible to enter or win. All federal, state, and local laws and regulations apply. This Contest is void in Puerto Rico and all other U.S. territories and possessions and where prohibited or restricted by law.

 

How to Enter the Contest: Go to https://firstdescents.org/polartec and follow the instructions for entry. To be an Entrant in the Contest, you will be required to enter your school name, first and last name of person to contact for the Event, email address, proposed Event details, and group affiliations (if any) to register.  After submission of the entry information, a member of the FIRST DESCENTS Staff will forward an email to the Entrant with a “Team FD Team Raiser” fundraising page link that the Entrant may use to advertise the Team and its Event and to use as a mechanism for the Entrant to receive donations for the Event.  Each Event must be compliant with all school rules and regulations as well as applicable federal, state, local and municipal laws. By submitting an entry, Entrant expressly acknowledges compliance with these Official Contest Rules, including all eligibility requirements.

 

LIMIT ONE (I) EVENT PER ENTRANT FOR THE DURATION OF THE CONTEST.  ANY ADDITIONAL EVENTS BY THE SAME ENTRANT WILL RESULT IN DISQUALIFICATION OF THE ENTRANT FROM THE CONTEST. 

 

Entry Period:  All Events must be completed and all donations must be accepted via the FIRST DESCENTS Team FD Team Raiser platform pages by 12 p.m. mountain standard time (“MST”) on December 13, 2013. Any donation that comes in after that time will be accepted on behalf of FIRST DESCENTS but will not be counted as a donation to the Entrant for purposes of this Contest and the determination of the overall winner.  The Entrant that raises the most money as verified by the total shown on the Entrant’s Team Raiser page for FIRST DESCENTS by 12 p.m. MST on December 13, 2013 will be the winner (“Contest Winner”).

 

Event Criteria:  Events that are deemed by Polartec and FIRST DESCENTS, in their sole discretion, to be offensive, immoral, obscene, profane, defamatory, not in keeping with the image of the Sponsor or FIRST DESCENTS, or in violation of these Official Contest Rules, are not permitted and any Entrant offering such an Event will be disqualified from this Contest.   Any advertising or publicity associated with an Event that disparages or portrays the Sponsor, FIRST DESCENTS, or any of the other competing Entrants in a negative light, or otherwise violates these Official Contest Rules, will result in the disqualification of the Entrant from this Contest.

 

Contest Winner and Notification: The Contest Winners will be identified on December 13, 2013 at 12 p.m. MST as the top three Entrants having the highest monetary donations received by FIRST DESCENTS out of all participating Entrants.  The top three Contest Winners will be notified by e-mail by December 16, 2013.

 

Odds of Winning:  The odds of winning a prize in the Contest depend upon the number of eligible Entrants received during the Entry Period and the quality of the Events. 

 

Prizes and Approximate Retail Value (“ARV”): The following prizes will be awarded to the Contest Winner:

 

(a)       Polartec Jackets made with Alpha fabric (ARV of $250 each) will be awarded to members of the Contest Winner winning Team, up to a total of 15 garments.

 

(b)        Up to 15 pairs of Original Teva Sandals (ARV of $40 each)

 

(c)       1 Dagger Katana Kayak- Crossover Kayak Model (ARV of $1,000) will be awarded to the Event contact person.

 

(d)      1 GoPro HERO3 Camera (ARV of $300 each) will be awarded to the Event contact person

 

(e)       10 boxes of Kind Snacks Bars– (ARV of $15 each) as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team

 

2nd Place Prizes: The following prizes will be awarded to the 2nd place winner.

 

(a) Smith Optics sunglasses (ARV of $100 each), as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team, up to a total of 15 sunglasses.

 

(b) Up to 10 First Descents branded t-shirts (ARV of $25 each) as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team

 

(c)  5 boxes of Kind Snacks Bars– (ARV of $15 each) as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team

 

3rd Place Prizes: The following prizes will be awarded to the 3rd place winner.

(a) Up to 10 First Descents branded t-shirts (ARV of $25 each) as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team

 

(b) 5 boxes of Kind Snacks Bars– (ARV of $15 each) as chosen by Sponsor in its sole discretion, will be awarded to members of the Contest Winner Team

 

 

 

Prize Delivery and Conditions: Prizes will be delivered by January 30, 2014, once the Contest Winners have been verified. If any prize is unclaimed, if any prize notification or prize is returned as undeliverable, or if the Contest Winners are found ineligible or not in compliance with these Official Contest Rules, the prize will be forfeited and the Entrant that raised the next highest amount will become the Contest Winner. All federal, state, and local taxes, and all other costs associated with acceptance or use of the prizes are the sole responsibility of the Contest Winners. A Contest Winner may waive his/her right to receive a prize. All Contest prizes are non-transferrable, non-exchangeable, and non-refundable, and must be accepted by the winner as awarded.  Sponsor reserves the right, in its sole discretion, to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

 

General Conditions:  Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Contest, including the submission of donations, or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.  If, for any reason, the Contest is not capable of running as planned, Sponsor may, in its sole discretion, (a) cancel or terminate the Contest; (b) modify the Contest; or (c) suspend the Contest to address any impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules.  Sponsor is not responsible for late, lost, incomplete, stolen, or misdirected entries or donations. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the submission of donations, or to be acting in violation of these Official Rules. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other cause that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Contest. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Sponsor is not responsible for damages incurred during the Contest for illegible, late, or unintelligible Event materials made by Entrants, or for printing or other errors appearing in these rules or other Contest materials, misprints or errors in other Contest-related information, technical or mechanical malfunctions, or other malfunctions, problems or errors, whether caused by equipment, programming used in this Contest, processing errors, human errors or otherwise.

 

Applicable Law: This Contest is governed by the laws of the Commonwealth of Massachusetts without regard to any choice of law provisions.

 

Privacy:  Entrants consent to the collection, use, and disclosure of their personal information by the Sponsor for the purposes of administering the Contest. The Contest Winner’s school name will be disclosed on the Sponsor’s website and to the public in general.  Sponsor’s privacy policy, available at www.Polartec.com, will govern the use of all personal information collected in connection with this Contest.

 

Limitation of Liability and Remedies: Neither the Sponsor, FIRST DESCENTS, nor any other Promotion Party shall have any liability for any direct, incidental, indirect, special, or consequential damages, or exemplary or punitive damages arising out of or relating to this Contest, including without limitation any liability, loss, injury or damage to Entrant or any other person or entity, including personal injury or death, or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of Entrant’s entry in this Contest, participation in any Contest-related activities, including participation in the Event, or the acceptance, possession, use, or misuse of any prize.

 

RELEASE AND INDEMNIFICATION:  BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE TO RELEASE AND HOLD THE SPONSOR AND FIRST DESCENTS HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHT, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE CONTEST OR PARTICIPATION IN ANY CONTEST-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ACCESS TO ANY MATERIALS, OR RESULTING DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.

 

Official Contest Rules: The Contest will be run in accordance with the Official Contest Rules, subject to amendment by Sponsor. Entrants must comply with the Official Contest Rules and will be deemed to have received and understood the Official Contest Rules by participating in the Contest. The terms of the Contest, as set out in the Official Contest Rules, are not subject to amendment or counter-offer, except as set out herein. Sponsor’s decisions with respect to the Contest are final and binding. If any provisions of the Official Contest Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

 

Publicity Release:  Except where prohibited, by accepting a prize, the Contest Winners, and each member of the top three Contest Winner Teams, grants permission for Sponsor and its agents to use his/her name, voice and/or likeness, for advertising, merchandising, promotion and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
